General

You are provided with access to this website in accordance with these Terms and Conditions and any orders placed by you must be placed strictly in accordance with these Terms and Conditions. This website, located at www.midlandfireonline.com is operated by Midland Fire On-Line. References to Midland Fire On-Line and ‘we’, ‘us’ and ‘our’ shall be deemed to be references to Midland Fire On-Line. References to ‘you’, and ‘your’ shall be deemed to be references to persons placing an order from the www.midlandfireonline.com .

 

Orders

When you place an order with Midland Fire On-Line it will be deemed that you have read, understood and agreed to these Terms & Conditions. If you are unhappy with any part of these Terms and Conditions, you should contact us prior to placing your order. By placing an order through our website you are making an offer to Midland Fire On-Line to purchase the goods outlined in your order upon the terms described in your order. When you place an order, we will require your name, email address, credit/debit card or PayPal, telephone and address details. This information is required in order to process your request or inform you of acceptance of your order. A contact telephone number is needed so that we can get in touch if there is a problem with your order. We may, unless you inform us otherwise, provide our delivery couriers with your contact telephone number in case they need to reach you. Please take care when adding these vital details. You must notify us immediately of any changes to your personal information. You can order by web order, telephone, email or post.

After placing an order online, we will send you email confirmation that your payment has been received but this is not confirmation that your offer to buy the goods has been accepted. If you do not receive a confirmation email from us it maybe that your email has an error within it. Our system cannot determine typos!

Our contract for the sale of our products will only exist once an order has been processed and despatched to you. Midland Fire On-Line reserves the right to reject any offer of purchase by you at any point. Please note that we may not be able to meet our obligations as a result of the following reasons:

  • If we are unable to deliver due to exceptional conditions that are beyond our control such as poor weather, accidents, road or airport closures or strikes etc.
  • The goods you ordered are out of stock. This occasionally happens even when they appear in stock if several orders are placed simultaneously.
  • A product is recalled by a manufacturer for whatever reason.
  • A product description or pricing detail is incorrect. This does not affect your statutory rights.
  • We are unable to process your payment for whatever reason or the payment is reversed.
  • All other Terms and Conditions are not met. 

 

You will receive a further email letting you know that your goods have been despatched. Should there be an issue with your order, we will always attempt to contact you by telephone or email. Please ensure that you check all items on receipt and inform us immediately of any problems.

Please note that whilst we will make every effort and reasonable care to keep your order details and payment secure, we cannot be responsible for any loss you may suffer if a third party obtains unauthorised access to any information that you supply when accessing or ordering from the Midland Fire On-Line.

This website is expressly offering a service to supply professional products from participating companies and manufacturers directly to companies and individuals (buyer) who are offering (reselling) the products as part of a professional service they provide to design, install and maintain professional solutions to their customers or for their own use. Midland Fire On-Line expects  buyers (companies and individuals) purchasing products to have expertise in the service they offer their customers and to know and understand the suitability for purpose of the products as offered for sale via the e-commerce website prior to entering into an agreement to buy.

Whilst every effort has been taken to ensure correct images and technical details are supplied, no warranty is given as to the correctness of this information which is reproduced "as is" and as supplied by the manufacturer, it is the responsibility of the manufacturer to update and supply these details, all of which are subject to change without notice, if in doubt, please contact the manufacturer direct for latest versions of documents and or technical data sheets.

 

Professional Products

Products offered from our manufactures to buyers on this website are intended for installation by trained and qualified security professionals, Midland Fire On-Line remind our buyers that Part P of the Building Regulations, which specifically deals with electrical safety in dwellings, came into effect on 1st January 2005. Many of the products supplied will require connecting to the electrical supply in a way which will require a part P certificate. In addition, rules regarding sighting of equipment in wash rooms, bathrooms etc. may apply, if in doubt a qualified electrical engineer should be consulted.

Some of the products offered for sale may require professional system design, installation and maintenance to meet insurance, fire authority, and other regulatory requirements, these products include (but are not limited to) safes, intruder alarms, electronic locks and fire alarms. If buyers are intending to fit these products it is their responsibility to ensure any insurance company and local fire authority are prepared to accept the system as installed. Failure to ensure this could result in insurance policy invalidation, revocation of fire certificate and or criminal liability.

By purchasing you are confirming that you are suitably trained and qualified. We remind buyers that some of the products offered for sale may require professional system design, installation, commissioning and maintenance to meet insurance, fire authority, and other regulatory requirements.

It is the buyer’s responsibility to ensure that any products purchased meet all regulatory requirements by means of design, installation and commissioning.  Failure to ensure this could result in insurance policy invalidation, revocation of fire certificate and/or criminal liability. Midland Fire On-Line and our manufactures accept no liability for losses however incurred.

 

Technical Support

Midland Fire On-Line is unable to provide assistance to help buyers decide which products should meet your requirements as described. Midland Fire On-Line is unable to provide on-going support to assist with technical issues after the sale, please contact the manufacturer for technical support. Midland Fire On-Line is unable to provide installation training or advice on insurance, fire authorities or other interested parties requirements. Advanced technical support is the responsibility of the manufacturer direct, Midland Fire On-Line are not liable to provide these for a buyer, where Midland Fire On-Line are involved our liability is limited to passing information as supplied by the manufacturers to our buyers, no liability is accepted by Midland Fire On-Line for the accuracy of this information.

Any recommendations or assistance provided by Midland Fire On-Line concerning the use, design, application, or operation of the goods shall not be construed as representations or warranties of any kind, express or implied, and such information is accepted by a buyer at the buyer’s own risk and without any obligation or liability to Midland Fire On-Line.  It is the buyer’s sole responsibility to determine the suitability of the goods for use in the buyer’s application(s).  The failure by Midland Fire On-Line to make recommendations or provide assistance shall not give rise to any liability to Midland Fire On-Line.

 

Product Pricing and Descriptions

Every product bought is sold subject to its product description. We undertake all reasonable care to ensure that all the details, sizes, prices, colours and descriptions of products are accurate and up to date. Sometimes photographs are not a true representation of actual colour. If you feel a product does not match its description please contact us immediately. All published prices exclude VAT at UK rate. We reserve the right to alter prices and products if necessary.
Legislation prohibits the sale of certain products to persons under certain ages. Knives and other bladed items for sale on this site cannot be sold to persons under the age of 18 under the Offensive Weapons Act 1996. Such products are flagged as such and if you are purchasing such items by agreeing to these terms you are deemed to also certify you are of legal age to buy such products.

 

Contract Cancellation

If you are not happy with products you have chosen and/or received, you are entitled to cancel this contract if you so wish under the Distance Selling Regulations, provided you exercise the cancellation within the period of 7 working days, beginning with the day following the day on which the goods were delivered, (excluding personalised items or made to order items). Returns

The Company supplies all goods with the following returns policy for buyers:

A buyer who cancels an order or who receives an order and wishes to return the goods, should inform the Company in writing that they wish to cancel the order within seven days of the date the order was placed with the Company, or seven days of receipt of the goods (whichever is the longer). The Company shall refund the buyers full invoice amount within 28 days of receiving the goods, subject to inspection and them being returned 'as new' in a re-saleable condition. The buyer will be liable for any damage to the goods, however caused, and the Company shall withhold the amount it deems necessary from the buyers refunded amount.

Goods Faulty on Arrival - If you are reporting faulty goods within 3 days of receipt (please note that for business customers, this is 3 days), and when the goods are returned to us complete, we will issue a full refund to you via your original payment method.

Goods Damaged in Transit - If the goods are damaged in transit, the Company request that the customer report it to the Company within 24 hours from receipt of goods. If goods are visibly damaged on receipt, the customer should sign the delivery note accordingly. Once the damaged goods have been collected and received back into the Companies warehouse, the Company will issue a full refund to the customer via their original payment method.

Goods Faulty in Warranty Period - If the customer is reporting faulty goods after 28 days of receipt, then provided the product is within its warranty period, the customer is entitled to a warranty repair or replacement. In some cases, manufacturers provide warranty support and repair services and/or telephone help facilities for the customers convenience. This does not affect the customers rights to claim against the Company under the Sales of Goods Act (as amended) if the goods do not conform to the contract and the manufacturer does not repair or replace the goods or offer the customer an alternative remedy.

Change Your Mind - If the customer changes their mind and is a consumer (not applicable to business customers), and the goods have not been in their possession for over 14 days, then the customer is entitled to return the goods to the Company for a full refund on condition that the customer take reasonable care of the goods until they are returned to the Company. In particular this means that you will: - not open shrink-wrapped or blister pack products or break any manufacturer’s seals. - return in good condition including all packaging, manuals, cables etc. - return the goods in a condition that would enable the Company to resell them as new - Please note that if the customer changes their mind the cost of returning goods is the responsibility of the customer.

If the customer changes their mind and are a business customer the Company does not accept the return of goods.

 

Warranty

Warranties are provided directly by the manufacturer on a return to base basis and are expressly provided under the individual manufacturer terms, full up to date copies of each manufacturer terms are available on request.

Advanced replacements can be facilitated, however as Midland Fire On-Line do not have pre-arranged account facilities with their buyers, all advanced returns will require payment in advance which will be refunded in full after Midland Fire On-Line are in receipt of a credit note from the relevant manufacturer.

NOTE: as all returned goods are fully checked prior to credit, this can take 7 - 60 days depending upon the manufacturer.  
 
Midland Fire On-Line is a distributor of the goods. Midland Fire OnLine makes no warranty whatsoever whether express or implied, in respect of the goods whether relating to their marketability, quality and/or fitness for purpose and/or any particular use. Midland Fire On-Line will not be liable for any damages whatsoever in respect of any warranty relating to the goods, but Midland Fire On-Line will make available to buyers the published warranties of the manufacturer to the extent Midland Fire On-Line have the right to such warranties. A copy of the published warranty given by our manufacturers which have manufactured the goods can be provided upon request.
 
The above warranties and conditions are sole and exclusive and no other warranties, express or implied, (other than the terms implied by section 12 of the Sale of Goods Act 1979), including those of satisfactory quality and fitness for particular purpose, shall apply to the goods. Midland Fire On-Line does not represent or warrant that the goods may not be compromised or circumvented or that the goods will prevent any personal injury or property loss, burglary, robbery, fire or otherwise; or that the goods will in all cases provide adequate warning or protection.  Buyers understands that a properly installed and maintained alarm may only reduce the risk of burglary, robbery, fire or other events occurring without providing an alarm, but it is not an insurance or guarantee that such will not occur or that there will be no personal injury or property loss as a result. These warranties are for the benefit of the buyer only and are not assignable or transferable.

 

Certification

All products offered for sale are marked as tested to required standards as appropriate for sale in Europe including CE, ROHS, R&TTE and are marked WEEE where appropriate, Midland Fire On-Line are not responsible for ensuring these tests are conducted, we choose high quality manufacturer who supply products pre tested and marked to standards as appropriate for the products offered for sale, copies of test certificates and other appropriate documents will be supplied by the manufacturer on request.

 

Payment Options

•We accept UK registered Visa Credit, Visa Debit and MasterCard.
•We accept cheques from UK bank issuers made payable to Midland Fire, Safety & Electrical Services Ltd.
•We accept payment via PayPal.
•We accept direct funds transferred into our bank account.

All prices are shown in £ Sterling and are exclusive of UK VAT at the current rates and are correct at the time of entering the information on to the system. The total cost of the order is the price of the items ordered plus the delivery charge.

Our Payment Service Provider for credit card processing  is Sage Pay (formerly Protx) – the largest independent payment service provider (PSP) in the UK and Ireland.

All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of a buyers payment card refuses to, or does not for any reason, authorise payment then the buyer will be notified of this at the checkout stage.

In assessing a buyer’s eligibility, we may use the information provided for the purposes of the prevention and detection of fraud.
